Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ezybooked website at ezybooked.com and the ezybooked booking and venue management platform (collectively, the "Service") provided by ezybooked ("ezybooked", "we", "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business you represent. When you create an account, you agree to provide accurate information, keep your login credentials secure, and accept responsibility for all activity that occurs under your account.

2. Subscriptions and fees

Access to the platform is provided under a subscription or order arrangement agreed separately with us. Pricing is provided on request and may vary based on your requirements. You agree to pay all applicable fees and taxes for the plan you select. Unless otherwise stated, fees are non-refundable except as required by law.

3. Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent or harmful purpose;
  • copy, modify, reverse engineer or attempt to extract the source code of the Service;
  • interfere with or disrupt the integrity or performance of the Service;
  • attempt to gain unauthorised access to the Service or related systems; or
  • upload content that is unlawful, infringing or that you do not have the right to use.

4. Your data

You retain ownership of the data you and your customers submit to the platform ("Customer Data"). You grant us a limited licence to host, process and use Customer Data solely to provide and improve the Service. You are responsible for the accuracy of Customer Data and for obtaining any consents required to provide it to us.

5. Intellectual property

The Service, including all software, design, text, graphics, logos and trademarks, is owned by ezybooked or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, nothing in these Terms transfers any ownership to you.

6. Third-party services

The Service may integrate with or link to third-party services. Your use of those services is governed by their own terms, and we are not responsible for them.

7. Availability

We aim to provide reliable access to the Service but do not guarantee that it will be uninterrupted or error-free. We may perform maintenance or update the Service from time to time, which may temporarily affect availability.

8. Disclaimers and liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, and we are not liable for any indirect, incidental or consequential loss. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the Service or paying the cost of having it re-supplied.

9. Indemnity

You agree to indemnify us against any claims, losses or damages arising from your breach of these Terms, your misuse of the Service, or your Customer Data.

10. Termination

Either party may terminate the Service in accordance with the applicable subscription arrangement. We may suspend or terminate your access immediately if you breach these Terms. On termination, your right to use the Service ceases, and we may delete Customer Data in accordance with our retention practices and applicable law.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

12. Changes to these Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
